Most people feel that once they have made a will, then they are ‘leaving their affairs in order’, and it is always a good idea to have a will, especially if you have a family. If you don’t make a will, then the law takes over, and the outcome could be that your estate is not dealt with as you would have wished. Worse, you could cause problems for your family and sow the seeds of a dispute. A will makes your intentions clear and enforceable, and gives you peace of mind. Protecting your assets from care costs is a thorny subject for many and getting the right advice is important.

We also always advise clients to give serious consideration to making a ‘Power of Attorney.’ We all hope that we will retain the ability to make decisions for ourselves throughout our lives, but sadly, this is not always the case. Illness or injury can rob us of the ability to make decisions for ourselves. In that unhappy eventuality, in the absence of a Power of Attorney, either a family member, or the local authority, will have to go to court to get a Guardian appointed – a time consuming and expensive process.

A Power of Attorney gives you the say over who is to manage your affairs, what type of decision or steps that they can take on your behalf, and when. Most clients are happy to appoint a close family member from a younger generation to be their attorney, but you can also appoint a professional person.
